End User License Agreement

This Agreement is between you and learnhubplay (KVK 97741825), at Tervurenpad 4, 1066 JV Amsterdam, Netherlands ("we", "us"), for the Tend software. By installing or using the Software, you agree to these terms.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software on devices you own or control, for personal or internal business use.

2. Restrictions

You may not resell, redistribute, rent or sublicense the Software itself; reverse engineer it except where permitted by law; remove proprietary notices; or use it unlawfully.

3. ⚠️ Data loss & your responsibility — read this

Tend can move files, caches and application data to the Trash, change system settings, quit processes, and free ports.

You are solely responsible for choosing what to clean, remove, quit or change.
Deletions normally move items to the macOS Trash (recoverable), but some actions (emptying the Trash, pruning Docker, force-quitting) are permanent or may lose unsaved work — these are clearly labelled and require confirmation.
You are responsible for maintaining your own backups (e.g. Time Machine) before using cleanup features.
We are not liable for any loss of data, files, settings or work arising from your use of the Software.

4. Third-party services (AI Assistant)

The optional AI Assistant is for users aged 18 or older, uses your own billing-enabled Google Gemini project, and sends disclosed data to Google under your account. Google currently requires Paid Services for API clients offered in the EEA, UK, and Switzerland. Output is labelled AI-generated, may be inaccurate, and is not for high-impact decisions. We are not responsible for Google's services, output, availability, or charges.

5. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. This does not exclude mandatory consumer conformity guarantees, remedies, or security-update duties. A consumer may be entitled to conformity, price reduction, or termination as provided by applicable law.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR LOSS OF DATA, PROFITS OR GOODWILL. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE PRIOR 12 MONTHS (currently $0 for the free launch). Nothing here limits liability that cannot be limited by law.

7. Free distribution and future commercial offers

Tend is supplied free at launch. There is no checkout, paid licence, subscription, or payment to refund. Before introducing a paid offer, learnhubplay will publish the seller, total price, taxes, payment/refund terms, conformity remedies, and any required EU digital-content withdrawal consent. Tend does not itself obtain or presume that consent.

8. Updates and support period

Tend 1.x will receive security updates through at least July 15, 2031. Users may need the latest public release to receive fixes. Mandatory update rights remain unaffected.

9. Governing law

This Agreement is governed by the laws of the Netherlands, except where mandatory consumer-protection law in your country of residence applies.
